Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

ELIGIBILITY:  Only legal residents of the fifty (50) United States who are 21 years of age or older are eligible to enter (age lowered to 18 as of 4/2/2010. See “Update” at end of these Official Rules.). Not open to employees, officers, or directors – or to members of the immediate family or household of any employee, officer, or director – of Green Bullion Financial Services, LLC dba Cash4Gold (”Cash4Gold” or “Sponsor”) or its respective parents, subsidiaries, or affiliates, or any advertising or promotion agencies involved in the Sweepstakes (collectively, the “Sweepstakes Entities”). 

SWEEPSTAKES PERIOD:  The One Millionth Transaction Celebration Sweepstakes (the “Sweepstakes”) begins March 9, 2010, and ends on August 31, 2010.  By entering, you accept and agree to comply with and abide by these Official Rules and the decisions of the judges, which shall be final and binding in all respects.

HOW TO ENTER:   You will automatically receive one (1) entry into the Sweepstakes for each Jewelry Return Pack (”Pack”) you send to Cash4Gold during the Sweepstakes Period, and that Cash4Gold receives in accordance with these Official Rules.  You do not have to accept payment from Cash4Gold for any item(s) you submit in your Pack.  You may also enter without submitting a Pack by hand-printing your name, complete street address, telephone number, and email address (if any), and mailing your completed entry in an envelope to: Green Bullion Financial Services, LLC, attn: One Millionth Transaction Celebration Sweepstakes, 2800 Gateway Drive, Pompano Beach, Florida 33069.  All Packs or written entries must be postmarked or delivered to the applicable carrier by August 31, 2010, and must be received by September 13, 2010.  Each Pack or entry must be submitted/mailed separately.

DRAWING AND WINNER NOTIFICATION:  One (1) winner of the Sweepstakes will be randomly selected from all eligible entries received.  The random drawing will be conducted on or about September 20, 2010.  The potential winner will be notified by telephone, mail, and/or email using the contact information given at the time of entry.  No liability is assumed for any winner notification that is lost, intercepted, or not received by a potential winner for any reason.  If a potential winner does not respond within ten (10) days after the first notification attempt or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected.  If any potential winner is found to be ineligible or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.

PRIZES/ODDS:   One (1) Grand Prize is available: $2,500.00 and an opportunity to appear in a Cash4Gold television commercial featuring M.C. Hammer.  The Grand Prize consists of: a one-time payment of $2,500.00; roundtrip coach air transportation for winner between the major U.S. airport nearest winner’s home and the location of the commercial shoot (to be determined); one night hotel accommodations (one room, single occupancy and related meals for winner at hotel during one-night stay – alcoholic beverages not included) at location of commercial shoot; and an opportunity to meet M.C. Hammer and appear in a Cash4Gold television commercial with M.C. Hammer.  Approximate retail value $3,800.00; actual value may vary depending on departure city and dates of travel.  If winner lives near location of commercial shoot, ground transportation may be substituted for air.  Major credit card may be required by hotel at check-in to cover incidental expenses.  No cash alternative or prize substitutions will be allowed.  Specific dates for trip and all accommodations are subject to availability and approval by Sponsor.  Sponsor will endeavor to schedule travel for winner at a mutually agreeable date and time, expected to be prior to March 31, 2011.  Creation, content, and airing of any Cash4Gold television commercial is at Sponsor’s sole discretion and cannot be guaranteed.  Advertising and marketing plans are subject to change.  If television commercial is filmed, the content, creation, date and time of filming, and date and time of airing the commercial are at Sponsor’s sole discretion.  Creation of commercial does not guarantee that commercial will be aired or that winner will appear in commercial on air.  In the event the commercial is not created as planned, winner will receive cash and remainder of trip.  Prize may not be transferred, except in Sponsor’s discretion.  Sponsor may award a substitute prize of comparable or greater value if any prize listed becomes unavailable for any reason.  Odds of winning depend on the number of eligible entries received.  Sweepstakes is open to over 100,000,000 adults in the United States.

GENERAL PRIZE CONDITIONS:  Winner will be issued an IRS Form 1099 for the value of the prize.  Winner is solely responsible for payment of all federal, state, and/or local taxes related to the prize and for any other fees or costs associated with acceptance or use of any prize not specifically included in the prize description.  Each potential winner may be required to execute an Affidavit of Eligibility and a Publicity Release (collectively, “Prize Claim Documents”).  Winner also must agree to all terms that may be required for participation in the creation of the Cash4Gold television commercial, including but not limited to any requested liability and publicity releases which must be signed and returned upon request as a condition for such participation.  Winner also may be subject to a background check and other confirmation of suitability to appear in the Cash4Gold commercial in Sponsor’s sole and absolute discretion.    

GENERAL PROVISIONS:  Acceptance of a prize constitutes winner’s permission for Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements, and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation except where prohibited by law.  Entrants agree that the Sweepstakes Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses, or damages of any kind, including, without limitation, death and bodily injury, due, in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from any entrant’s acceptance, receipt, possession, and/or use or misuse of any prize, and (B) have not made any warranty, representation, or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. 

No responsibility is assumed for any computer system, phone line, hardware, software, or program malfunctions, or other errors, failures or delays.  Without limiting the generality of the foregoing, no responsibility is assumed for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone, or cable transmissions; or for any technical malfunctions, failures, difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. 

Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten, or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.  No mechanically reproduced, illegible, incomplete, forged, software-generated, or other automated multiple entries will be accepted. 

In the event of a dispute as to the identity of the entrant, the entrant is the person named in the Pack submission or postal mail-in entry selected as the potential winner. 

Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud, technical problems, failures, malfunctions, or other unintended circumstances have impaired the integrity, administration, security, proper play, and/or feasibility of the Sweepstakes as contemplated herein.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the winner in a random drawing from all eligible, non-suspect entries unaffected by the problem.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances. 

WINNER’S LIST/OFFICIAL RULES:  To obtain the name of the winner, available after November 1, 2010, send a self-addressed stamped envelope to Green Bullion Financial Services, LLC, One Millionth Transaction Celebration Sweepstakes, 2800 Gateway Drive, Pompano Beach, Florida 33069. All such requests must be received by November 30, 2010.  These Official Rules will be posted on the Cash4Gold website at www.cash4gold.com.

UPDATE: As of April 2, 2010, Cash4Gold modified its general Terms of Use Agreement to allow persons ages 18 and older to submit Jewelry Return Packs. Prior to that date, the minimum age was 21. In accordance with this change in general business practices, as of the same date, the minimum age for participation in this Sweepstakes has become 18. In the event any potential winner age 18-21 is deemed a minor under the laws of his/her state of residence, all Prize Claim Documents must be signed by a parent or legal guardian who must also give written consent for the winner to accept the prize and who must also sign any additional documents required under the Official Rules on behalf of the winner.
