This website (the “Site”) is operated by Cash4Gold (“Cash4Gold”). Throughout the Site, the terms “we”, “us” and “our” refer to Cash4Gold and its successors and assigns. We offer this Site, including all information available from this Site, subject to your acceptance of these Terms and Conditions, Privacy Policy, and any other notices posted on the Site (“Terms”). The terms “you” and “your” refer to the person or persons sending gold, platinum, silver, and diamond jewelry, or other precious metals (hereinafter “Merchandise”) to Cash4Gold for sale and purchase (hereinafter a “Transaction”).
By sending your Merchandise to us, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
1. Our Goal
Our goal is to create a fair and transparent trading environment by offering a competitive payment for your merchandise following evaluation and processing, generally within 24 hours of receipt.
2. Ownership of Merchandise
You represent and warrant that:
- You are at least 18 years old.
- You are the legal owner of the Merchandise you wish to sell to us.
- You are acting on your own behalf, not as an agent or representative of another.
- Your Merchandise is free of any claims, liens, or other encumbrances that could affect its value or your ability to sell it to us.
3. Compliance with Government Agencies
Effective October 1, 2009, the State of Florida (Statutes Section 538.32) requires Cash4Gold to obtain your driver’s license number (or other government-issued ID) and a signed sworn statement to process payment.
4. Describing Your Merchandise
You agree to accurately list and describe the Merchandise on the packing slip provided by us or printed from our website. If we reasonably determine, in our sole discretion, that there are significant discrepancies between the Merchandise described and the items we receive, or if no packing slip is included, we may suspend or terminate the Transaction. In such a case, we will return your Merchandise within two (2) business days at our cost via FedEx, and we will only be responsible for insuring the value of your Merchandise up to $100.
5. Inbound Shipping Methods, Costs, Insurance
You may select one of the following shipping options on the Site:
FedEx
If you use a FedEx label provided by us, Cash4Gold will cover inbound shipping and insurance up to $2,500 per Transaction. In the event of loss or damage, we will file a claim with FedEx and pay you any settlement received up to the coverage limit. You are responsible for any value above $2,500
Ship It Myself
If you choose to ship at your own risk and expense, you must:
- Use your own shipping method and insurance for full value;
- Arrange tracking and waive all claims against Cash4Gold for loss or damage during transit.
Any claims must be made against the shipper directly.
We may replace FedEx with another carrier if needed.
6. Receipt of Merchandise
All inbound packages are videotaped for security. We may reject tampered or damaged packages at our reasonable discretion; rejected packages are not deemed received. You will be notified by email when your Merchandise is received and logged.
7. Valuing Your Merchandise
We assess value based on the London Gold fixing, karat, weight, and other factors deemed reasonably appropriate. Values will be available via GoldView on our website. You are responsible for maintaining your own account and password.
8. Settlement
You will receive a settlement notice via email or telephone. You must accept or decline your settlement within 24 hours. Failure to respond will be deemed acceptance, and payment will be issued according to the method selected. Once accepted, Merchandise becomes property of Cash4Gold and may be melted or refined.
9. Settlement Paid by Company Check
You may decline the settlement within 10 business days by notifying us and returning the un-cashed check. Failure to do so results in forfeiture of your right to decline, and the Merchandise will be processed as described above.
10. Return of Merchandise
If Merchandise is returned in accordance with these Terms, it will be shipped via FedEx at our expense, insured up to the full value of the rejected settlement. Merchandise lost in return transit will be claimed through FedEx up to $2,500 per transaction.
11. Limitation of Liability
Cash4Gold’s liability is strictly limited as follows:
- Maximum liability per Transaction is $2,500 via FedEx coverage only; Cash4Gold is not responsible for any amount exceeding coverage.
- Cash4Gold is not liable for:
- Incidental, special, indirect, consequential, or punitive damages.
- Lost profits or lost opportunities.
- Insurance subrogation claims. You expressly waive any such claims, including claims by your insurance carrier.
12. Miscellaneous
These Terms shall be governed by, and construed in accordance with, the laws of the State of Florida. Any disputes must be filed exclusively in the state or federal courts located in Broward County, Florida. You waive any objections based on personal jurisdiction or forum non-conveniens.
13. Electronic Signature
Clicking “Get Started” on the Get Started form constitutes your electronic signature, indicating your agreement to these Terms in accordance with the Florida Uniform Electronic Transactions Act
